1. Acceptance of Terms
By accessing or using the services provided by Spotbookr Inc. ("Spotbookr," "we," "our," or "us"), including, but not limited to, the platform and any related products, services, or software (the "Service"), you ("User," "you," or "your") agree to comply with and be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you are not authorized to access or use our Service. These Terms constitute a binding agreement between you and Spotbookr, and your use of the Service is contingent upon your acceptance of and compliance with these Terms.
2. Description of Service
Spotbookr provides a suite of social media advertising intelligence services, which includes, but is not limited to: advertisement detection, performance analytics, compliance verification, predictive modeling, and detailed reporting on the effectiveness of social media advertisements and influencer campaigns. The Service may also include additional features, tools, and services as further described in Spotbookr's documentation, website, and other communications. We may periodically update, enhance, or modify the Service at our discretion.
3. User Responsibilities
As a User of the Service, you agree to:
a. Compliance with Laws:
Use the Service in compliance with all applicable laws, regulations, and legal obligations, whether federal, state, local, or international.
b. Prohibited Uses:
You shall not engage in any activity that:
- Violates any intellectual property rights, including copyrights, trademarks, or other proprietary rights.
- Interferes with the functionality, integrity, or security of the Service, or disrupts other users' access or experience.
- Violates any applicable laws, including those relating to data privacy, intellectual property, or consumer protection.
- Introduces malware, viruses, or other harmful code into the Service or related systems.
4. Subscription and Payment Terms
Access to certain features of the Service requires a paid subscription. Subscription fees are billed according to the plan and billing cycle you select (monthly or yearly). In compliance with Indian Consumer Protection Act 2019, you may request a full refund within 7 days of initial purchase if you have not used the Service. After 7 days, fees are non-refundable except as required by applicable Indian law. Annual subscriptions may be eligible for pro-rated refunds within 30 days if unused.
a. Payment Processing:
We use Stripe, Inc. as our third-party payment processor. When you provide payment information during registration, you are providing it directly to Stripe. We do not store your full credit card numbers or payment card details on our servers. By providing payment information, you authorize us and Stripe to automatically charge your payment method for recurring subscription fees.
b. Billing and Renewals:
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged the then-current subscription fee. We reserve the right to change subscription prices with 30 days advance notice to existing subscribers. Failure to maintain valid payment information may result in immediate service interruption and account deactivation.
c. Account Activation:
Your account will be activated upon successful payment and email confirmation. If payment fails or your subscription is cancelled, your account will be immediately deactivated and you will lose access to all premium features. We process subscription lifecycle events including payment successes, failures, and cancellations through automated webhook integrations with our payment processor.
5. Intellectual Property Rights
All intellectual property rights related to the Service remain the property of Spotbookr. The Service, including all content, features, and functionality, is owned by Spotbookr. Our trademarks, service marks, and logos may not be used without prior written consent. Users retain ownership of their data but grant Spotbookr a license to use it for service provision. Any feedback or suggestions you provide may be used without compensation or attribution.
6. Data Privacy and Security
Spotbookr's data handling practices are governed by our Privacy Policy. We collect and process user data as described in our Privacy Policy, including account information, billing details, session data, and usage analytics. We implement industry-standard security measures including encryption, secure session management, and access controls.
Upon login, we establish secure sessions that track your IP address, device information, and activity for security and service optimization purposes. We maintain compliance with applicable data protection regulations and conduct regular security audits and updates. In the event of any security breaches, we will provide prompt notification as required by law.
7. Limitation of Liability
To the maximum extent permitted by law, Spotbookr is not liable for any indirect, incidental, or consequential damages. Our total liability is limited to the amount paid by you for the Service in the past 12 months. We make no warranties about the accuracy or reliability of the Service. The Service is provided "as is" without any guarantees of uninterrupted operation.
8. Term and Termination
These Terms remain in effect until terminated. You may terminate your account at any time by following the cancellation process. We may terminate or suspend your account for violations of these Terms. Upon termination, you lose access to all premium features. Relevant sections of these Terms survive termination. We may retain your data as required by law or for legitimate business purposes.
9. Miscellaneous Provisions
These Terms constitute the entire agreement between you and Spotbookr. If any provision is found invalid, the remaining provisions remain in effect. Our failure to enforce any right doesn't waive future enforcement. These Terms are governed by the laws of India, including the Indian Contract Act 1872, Information Technology Act 2000, and Consumer Protection Act 2019. Any disputes shall be resolved in the competent courts having jurisdiction in Bangalore, Karnataka, India. You may not assign your rights without our prior written consent. We may update these Terms with notice to users.
Spotbookr Privacy Policy

1. Information We Collect
Spotbookr collects the following categories of information in connection with your use of the Service:
a. Account Information:
When you register for an account, we collect your email address, username, password (stored as a cryptographic hash), full name, company name, job title, phone number, and billing address. This information is required to create and manage your account.
b. Payment and Billing Information:
We use Stripe, Inc. as our payment processor. When you provide payment information, it is transmitted directly to Stripe and subject to Stripe's Privacy Policy. We store your Stripe Customer ID and billing address but do not store complete credit card numbers or payment card details on our servers. We receive notification from Stripe about payment successes, failures, and subscription status changes.
c. Session and Authentication Data:
When you log in to our Service, we automatically collect and store session information including your IP address (from X-Forwarded-For headers or direct connection), browser user agent, login timestamp, session duration, and authentication status. We maintain active session records for security and service continuity, and we log all login attempts (successful and failed) with associated IP addresses and timestamps for security monitoring.
d. Usage and Activity Data:
We track your activity within the Service including search queries (brands, agencies, advertisement IDs, and tools searched), search timestamps, trending data aggregation, session activity patterns, and feature usage. This data helps us improve the Service and provide personalized recommendations.
e. Analytics and Tracking:
With your consent (managed through our consent manager), we use Google Analytics to collect usage statistics, page views, feature interactions, and user flow patterns. You can opt out of analytics tracking through our consent settings.
f. Communications:
We store all communications with our support team, including email correspondence, chat messages, and support ticket history. We also log all transactional emails sent to you (account confirmation, password reset, two-factor authentication codes, payment notifications).
g. Publicly Available Data:
Information that is publicly accessible via social media platforms, including but not limited to social media posts, engagement metrics, influencer performance data, and advertisement campaign analytics. This data is collected from public ad libraries and is not linked to your personal account.
2. Information Usage and Processing
We use and process your information for the following purposes:
a. Service Provision and Authentication:
To create and manage your account, authenticate your identity, establish and maintain secure sessions across our services, process your subscription payments through our payment processor, and provide access to premium features based on your subscription status.
b. Payment Processing and Billing:
To process your subscription payments via Stripe, manage billing cycles and automatic renewals, handle payment failures and retry logic, process refunds when applicable, activate or deactivate your account based on payment status, and send payment-related notifications and receipts.
c. Security and Fraud Prevention:
To monitor and log all login attempts, detect suspicious activity patterns, prevent unauthorized access, track active sessions for security auditing, maintain login history for security investigations, and implement two-factor authentication for enhanced account security.
d. Service Improvement and Analytics:
To track search patterns and trending topics, optimize search results and recommendations, analyze feature usage and user engagement, identify and fix technical issues, conduct A/B testing for new features, and generate aggregated usage statistics.
e. Communication:
To send account confirmation emails, deliver two-factor authentication codes, send password reset links, provide payment and subscription notifications, respond to support inquiries, and send service updates and announcements (with your consent for marketing communications).
f. Legal Compliance:
To comply with applicable laws and regulations, respond to legal requests and court orders, enforce our Terms of Service, protect our rights and property, and investigate potential violations of our policies.
3. Data Sharing and Disclosure
Spotbookr shares your information in the following circumstances:
a. Payment Processor:
We share your email address, billing information, and payment details with Stripe, Inc. for payment processing. Stripe processes this data in accordance with their Privacy Policy and PCI-DSS standards. We receive webhook notifications from Stripe about subscription events but do not receive your complete payment card details.
b. Analytics Providers:
With your consent, we share usage data with Google Analytics for website and application analytics. This data is processed according to Google's Privacy Policy. You can opt out of analytics tracking through our consent management system.
c. Email Service Providers:
We use our own email infrastructure (Postfix SMTP) to send transactional emails. Email delivery may involve third-party email routing services. We do not share your email address with marketing platforms unless you explicitly opt in.
d. Legal Requirements:
We may disclose your information in response to subpoenas, court orders, or other legal processes; to comply with applicable laws and regulations; to protect our rights, property, and safety; to investigate fraud or security issues; and in connection with legal proceedings.
e. Business Transfers:
In the event of a merger, acquisition, sale of assets, or bankruptcy, your information may be transferred to the acquiring entity. We will notify you via email or prominent notice on our Service before your information becomes subject to a different privacy policy.
f. Aggregated Data:
We may share aggregated or anonymized data that cannot reasonably be used to identify you, such as trending search statistics, usage patterns, and industry benchmarks.
4. Data Retention and Security
a. Retention Periods:
We retain different types of data for varying periods based on legal requirements and business needs:
- Account Information: Retained for the duration of your account plus 90 days after deletion for recovery purposes, then permanently deleted.
- Payment Data: Stripe Customer ID retained for the life of your account; billing history retained for 7 years for tax and accounting purposes.
- Active Sessions: Session tokens valid for 30 days; automatically expired and cleaned up after expiration.
- Login History: Retained indefinitely for security auditing and fraud prevention; may be anonymized after 2 years.
- Search History: Personal search history retained for 90 days; aggregated trending data retained for 30 days then deleted.
- Communication Records: Support communications retained for 3 years; transactional email logs retained for 1 year.
- Analytics Data: Google Analytics data subject to Google's retention settings (default 26 months).
b. Security Measures:
We implement comprehensive security measures to protect your data:
- Passwords stored using industry-standard cryptographic hashing (bcrypt/werkzeug)
- All connections encrypted with TLS/SSL (HTTPS)
- Session tokens generated using cryptographically secure random number generators
- Database access restricted to authenticated services only
- Regular security updates and vulnerability patching
- IP-based access controls and firewall rules
- Automated monitoring for suspicious login patterns
- Two-factor authentication available for all accounts
- Payment data never stored on our servers (handled by PCI-compliant Stripe)
c. Data Breach Notification:
In the event of a data breach that affects your personal information, we will notify you via email within 72 hours of discovery and provide details about the nature of the breach, data affected, and steps being taken to address the issue.
5. Your Rights and Choices
You have the following rights regarding your personal information:
a. Access and Portability:
You can access your account information, profile details, and billing history by logging into your account dashboard. To request a complete export of your data in machine-readable format, contact us at privacy@spotbookr.com. We will provide your data within 30 days of verification.
b. Correction and Updates:
You can update your profile information, billing address, and account settings directly through your account dashboard. For changes to your email address or other critical account information, contact support for verification purposes.
c. Account Deletion:
You can request account deletion by contacting admin@spotbookr.com. Upon verification, we will:
- Cancel your active subscription immediately
- Terminate all active sessions
- Delete your account information within 90 days
- Notify Stripe to remove payment methods from your customer profile
- Anonymize search history and login records
- Retain only data required by law (billing records for tax purposes)
d. Session Management:
You can view all active sessions from your account security settings. You can revoke individual sessions or all sessions except your current one. Session tokens are automatically invalidated after 30 days or upon logout.
e. Marketing and Communications:
You can opt out of marketing emails using the unsubscribe link in any marketing message. Transactional emails (account confirmations, password resets, payment notifications, 2FA codes) cannot be disabled as they are essential to Service operation.
f. Analytics Opt-Out:
You can disable Google Analytics tracking through our consent manager (accessible in your account settings or at first visit). This setting is stored in your browser and must be set on each device.
g. Two-Factor Authentication:
You can enable or disable two-factor authentication in your account security settings. We strongly recommend keeping 2FA enabled for enhanced security.
h. California Privacy Rights:
California residents have additional rights under CCPA including the right to know what personal information we collect, the right to delete personal information, and the right to opt-out of sale of personal information. Note: We do not sell personal information.
6. International Data Transfers
Spotbookr, Inc. is based in the United States. Your information is primarily stored and processed on servers located in the United States. If you access our Service from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States.
Safeguards for International Transfers:
- We use Stripe, Inc., which maintains PCI-DSS compliance and implements appropriate cross-border data protection measures.
- Data in transit is encrypted using TLS 1.2 or higher.
- We comply with applicable data protection laws including GDPR for European users.
- Our data processing agreements with third-party providers include standard contractual clauses where required.
- We implement technical and organizational measures to ensure data security regardless of location.
By using our Service, you consent to the transfer of your information to the United States and its processing in accordance with this Privacy Policy.
India Data Localization: For Indian customers accessing our Service from India, we comply with applicable Indian data protection laws. While your information may be stored on servers in the United States, we ensure appropriate safeguards are in place for international data transfers. Sensitive personal data as defined under Indian law is processed with your explicit consent.
GST and Taxes: All prices displayed in Indian Rupees (INR) are exclusive of Goods and Services Tax (GST). Applicable GST will be added to your invoice based on your billing address. We are registered under GST and comply with Indian tax regulations.
7. Updates to Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or Service features. When we make material changes, we will notify you by:
- Posting the updated Privacy Policy on our website with a new "Last Updated" date
- Sending an email notification to the address associated with your account
- Displaying a prominent notice within the Service dashboard
- Requiring acknowledgment of the new policy upon your next login for significant changes
We will provide at least 30 days notice before material changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Privacy Policy. If you do not agree with the changes, you must discontinue use of the Service and may request account deletion.
